Stairs: Virginia's numbers
Under the 2021 Virginia Residential Code, as reflected in Fairfax County's Typical Deck Details:
- Maximum riser height: 8¼ inches.
- Minimum tread depth: 9 inches.
- Maximum variation between risers or treads in a flight: ⅜ inch.
- Minimum stair width (Fairfax details): 36 inches.
- Handrail 34 to 38 inches high where there are four or more risers.
- Each stairway must be lit (Fairfax details).
Many national deck articles quote the model International Residential Code's 7¾-inch riser and 10-inch tread. Those aren't Virginia's numbers. If you're checking an existing deck stair here, measure against 8¼ and 9.
The ⅜-inch rule is the one that fails
Loudoun County lists stair riser variation over the code allowance among the most common reasons deck inspections fail. The usual culprit is the bottom step. If the landing pad or ground isn't exactly where the stair was laid out, the last riser ends up taller or shorter than the rest, and that one odd step is what people trip on. Measure every riser on your stairs, top to bottom; if one is noticeably different, that's worth fixing.
Guards: when they're required and how tall
A guard is required where the deck surface is more than 30 inches above grade, measured at a point 36 inches out from the edge. The minimum guard height on the deck is 36 inches. On stairs, guards must be at least 34 inches, and 34 to 38 inches where the guard also serves as the handrail.
Openings: the 4-inch sphere
No opening in a guard may let a 4-inch sphere pass through. On the triangle formed by a stair tread, riser and the bottom rail, the limit is a 6-inch sphere, and on stair guards the code allows 4⅜ inches. NADRA's checklist adds that the opening behind open stair treads should be no more than 4 inches. A simple check: a 4-inch ball, or anything about that size, shouldn't fit between balusters.
Guard posts
Fairfax County's details prohibit notching guard posts and require hold-down anchors rated at least 1,800 pounds. They also don't approve surface-mounted guard posts. Notching was common on older decks because it looks neat, but it removes much of the post's strength right where the load is. If your guard posts are notched where they meet the rim, and they move when you push, that's a priority repair.
Checking your own stairs and railings
- Measure each riser and tread with a tape. Compare against 8¼ inches and 9 inches, and look for any riser that differs by more than ⅜ inch.
- Count risers. Four or more means you need a handrail 34 to 38 inches high.
- Measure guard height from the deck surface. Under 36 inches on a high deck is out of date.
- Try a 4-inch object between balusters and under the bottom rail.
- Push firmly on guard posts at the top of the stairs and the deck corners.
- Check the stair stringers where they meet the ground or landing for rot.
- At night, check whether the stairs are lit.
Old stairs, new rules
An older deck may have been built when different numbers applied, or without a permit at all. That doesn't make it illegal to keep using, but it's a useful benchmark: a stair or guard that falls well short of today's riser, tread, height or opening rules is less forgiving than one that meets them. When a stair or railing section is rebuilt, plan on building it to current rules. That's also when a deck with mismatched stairs gets fixed properly, because the new run can be laid out from the actual landing height rather than an assumed one.
Repairing versus rebuilding stairs and railings
Loose balusters, a cracked cap rail or a single worn tread are repairs. Notched or rotted guard posts, stringers that are rotting at the base, or risers that don't meet the rules usually mean rebuilding that stair or railing section.
